The GP emergency service is responsible for all complaints that would require a visit to a GP. It begins when the normal doctor's offices close. It is organised by the Association of Statutory Health Insurance Physicians of Westphalia-Lippe (KVWL).

In all life-threatening cases such as heart attacks, traffic accidents or fainting, the emergency services are responsible and can be contacted on 112.

2. PURPOSE OF DATA PROCESSING

The data processing is carried out in accordance with legal requirements in order to fulfil the treatment contract between you and your doctor and the associated obligations.
For this purpose, we process your personal data, in particular your health data. This includes anamnesis, diagnoses, treatment suggestions and findings that we or other doctors collect. For these purposes, other doctors or psychotherapists with whom you are receiving treatment may also provide us with data (e.g. in doctor's letters).
The collection of health data is a prerequisite for your treatment. If the necessary information is not provided, careful treatment cannot be carried out.

3. RECIPIENTS OF YOUR DATA

We will only transfer your personal data to third parties if this is permitted by law or if you have consented.
Recipients of your personal data may be other doctors/psychotherapists, associations of statutory health insurance physicians, health insurance companies, the medical service of the health insurance company, medical associations and private medical billing offices.
The data is primarily transmitted for the purpose of billing for the services provided to you and to clarify medical questions and questions arising from your insurance relationship. In individual cases, data may be transmitted to other authorized recipients.

4. STORAGE OF YOUR DATA

We will only retain your personal data for as long as is necessary to carry out the treatment.
Due to legal requirements, we are obliged to retain this data for at least 10 years after completion of treatment. Other regulations may require longer retention periods, for example 30 years for X-ray records according to Section 28 Paragraph 3 of the X-ray Ordinance.

You have the right to receive information about the personal data concerning you. You can also request that incorrect data be corrected.

Before the swab is taken, an identity check is carried out using the identification document that the patient has provided for the test result certificate (e.g. passport). The patient must check that the information provided (name, date of birth, passport number) is correct (laboratory certificate and report).

The patient's claims for damages are excluded. This includes in particular damages (such as costs of rebooking flights, lost business deals, etc.) due to a delayed transmission of the results, an incorrect test result or because the results sent are not recognized by certain bodies, especially authorities, in Germany or in a destination country. This exclusion of liability applies to the benefit of the provider and the laboratory and their respective legal representatives and vicarious agents.
If the provider is unable to provide the service on the agreed date due to its own fault, the patient can choose whether the service should be provided at a different date or whether he or she should withdraw from the contract against reimbursement of the fee.
The contract between patient and provider remains binding in its remaining parts even if individual points are legally ineffective. The ineffective points will be replaced by the statutory provisions, if applicable.

Conditions for the so-called rapid antigen test


The patient consents to the collection of a sample by means of a swab inserted into the nose and/or throat. Even if the procedure is carried out with the greatest care, injuries such as slight bleeding or irritation may occur in individual cases.

The test result is usually available within 15-30 minutes after the swab has been taken. However, delays are possible in individual cases, so that the transmission of the results within this period cannot be guaranteed. We do not guarantee that the analysis of your swab sample will be carried out by a specific date/time and/or that the test results will be available by a specific date/time. In case of a positive result of the rapid test, the patient undertakes to undergo a PCR test immediately and to go into home quarantine.

In the event of a positive test result, this test result, including the personal data provided during registration, will be reported to the responsible health authority in accordance with legal requirements.

The federal government will cover the costs of the test as long as the government's offer of free citizen tests is valid. Billing through health insurance is not possible or is not required as long as the free tests are available.
